I agree that by participating in any Arctic Travel & Leisure AS related activities; therefore I am responsible for my own safety and welfare and agree that I knowingly and voluntarily assume the full risks involved in any such activity.

 

By accepting these terms of service you hereby confirm and acknowledge that I have been fully informed of the inherent hazards and risks associated with boating activities and traveling to and from activity sites of which you are about to engage in.

Inherent hazards and risks include but are not limited to:

The risk of injury from the activity and equipment utilized in boating is significant including

the potential for permanent disability and death. Exposure to water hydraulics, hidden or obvious obstructions, and/or debris found in the water can cause drowning or other harm. Possible equipment failure and/or malfunction of my own or others’ equipment. My own negligence. Hazards related to boating which include but are not limited to: collision, capsizing, sinking, or other hazards that may result in wetness, injury, exposure to elements, hypothermia, impact of the body upon the water, upon rocks, injection of water into my body orifices, marine life forms, and/or drowning. Heat related injuries and illness including but not limited to heat exhaustion, heat stroke, sunburn, hypothermia and dehydration. Exposure to outdoor elements, including but not limited to inclement weather, thunder and lightning, sever and or varied wind, temperature or weather conditions. Accidents or illness occurring in remote places where there are no available medical facilities. Fatigue chill, and/or dizziness, which may diminish my/our reaction time and increase the risk

of accident. My sense of balance, physical coordination, and ability to follow instructions.

By accepting these terms of service you understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death. I acknowledge that I may have to exercise extra care for my own person and for others

around me in the face of such hazards. I further understand that there may not be rescue or

medical facilities or expertise necessary to deal with injuries and damages to which I may be exposed. You are also aware that there is a risk of failure of the operators and their staff – including third party operators – to safeguard or protect me from the risks, dangers, and hazards or the activities.

By accepting these terms of service you agree that to the fullest extent allowed by law, you will not institute any lawsuit or other legal action against Arctic Travel & Leisure AS, its officers, directors, delegates, employees, staff, instructors, agents, representatives, servants, or assigns and all organizations and individuals assisting in promoting, conducting or otherwise affiliated with the activity as a result of my participation in or injury from any Arctic Travel & Leisure AS -related, Arctic Travel & Leisure AS -organized, Arctic Travel & Leisure AS -advertised, Arctic Travel & Leisure AS -sponsored or Arctic Travel & Leisure AS -subsidized activity.

In consideration for being permitted to participate in any way in boating tours and/or other activities, I hereby agree, acknowledge and appreciate that:

By accepting these terms of service you hereby release and hold harmless with respect to any and all injury, disability, death, or loss or damage to person or property, whether caused by negligence or otherwise, the following named persons or entities, herein referred to as releases: Arctic Travel & Leisure AS. To release the releases, their officers, directors, employees, representatives, agents, and volunteers, and vessels form liability and responsibility whatsoever and for any claims or causes of action that I, my estate, heirs, survivors, executors, or assigns may have for personal injury, property damage, or wrongful death arising from the above activities whether caused by active or passive negligence of the releases or otherwise. By executing this document, I agree to hold the releases harmless and indemnify them in conjunction with any injury, disability, death, or loss or damage to person or property that may occur as a result of engaging in the above activities.

SECTION 14 – INDEMNIFICATION

You agree to indemnify, defend and hold harmless Arctic Travel & Leisure AS and our parent, subsidiaries, owners, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party
